Court Marriage Procedure in Pakistan

Court marriage in Pakistan is a lawful and recognized process through which two consenting adults solemnize their marriage according to law. For Muslims, the procedure is primarily governed by the:

  • Muslim Family Laws Ordinance 1961
  • Family Courts Act 1964

For non-Muslims, marriages are regulated under their respective personal laws, including:

  • Christian Marriage Act 1872

Court marriage is a comparatively simple legal process intended to ensure that the marriage is performed with the free consent of both parties and properly registered under the law.


Court Marriage Procedure in Pakistan for Muslim Couples

Step 1 — Declaration of Free Will / Affidavit

The bride and groom are required to declare that they are entering into the marriage of their own free will, without any pressure, coercion, or undue influence.

For this purpose:

  • Separate affidavits/declarations are prepared.
  • The affidavits are attested by an Oath Commissioner or authorized official.

This declaration serves as legal proof of voluntary consent.


Step 2 — Verification of Identity Documents

Both parties are required to provide:

  • Original CNICs (Computerized National Identity Cards)
  • Copies of CNICs
  • Passport-size photographs

In some cases, B-Form or Juvenile Card may also be required where applicable.


Step 3 — Presence of Witnesses

At least two adult Muslim male witnesses are required for the Nikah ceremony.

The witnesses must:

  • Be sane and adult Muslims
  • Possess valid CNICs
  • Be physically present at the time of Nikah

Step 4 — Solemnization of Nikah

The Nikah is performed by a licensed Nikah Khawan or authorized religious officiant.

During the ceremony:

  • Offer and acceptance (Ijab-o-Qabool) are conducted
  • Haq Mehr (dower) is determined
  • The Nikah Nama is completed and signed

The following persons sign the Nikah Nama:

  • Bride
  • Groom
  • Witnesses
  • Nikah Khawan

Step 5 — Registration of Marriage

After solemnization, the Nikah Nama is registered with the relevant Union Council or Local Government authority.

Upon registration:

  • Official marriage records are maintained
  • A computerized marriage certificate may subsequently be obtained through National Database and Registration Authority (NADRA)

Legal Status of Court Marriage in Pakistan

Court marriages are legally recognized and enforceable in Pakistan.

The law protects the right of adult individuals to marry according to their free will and consent. The superior courts of Pakistan, including the Supreme Court, have repeatedly upheld the legality and validity of free-will marriages.

Additionally:

  • Constitution of Pakistan recognizes protection of marriage and family life.

Court Protection in Sensitive Cases

Where a couple fears harassment, threats, or unlawful interference from family members or other persons, legal protection may be sought through the courts.

The couple may file:

  • An application before the Sessions Court or relevant authority seeking protection.

The court may issue:

  • Protective directions
  • Orders restraining harassment
  • Directions to local police for security and protection

Expenses and Fees

Court marriage expenses may include:

  • Lawyer’s fee
  • Nikah Khawan fee
  • Affidavit and attestation charges
  • Documentation and registration expenses

The total cost may vary depending upon the city, legal assistance involved, and complexity of the matter.


Important Notes

  • For non-Muslims, marriage procedures are governed by their own personal and religious laws.
  • Consent of both parties is essential.
  • Marriage should preferably be contracted after attaining the legally recognized marriageable age.
  • Proper registration of marriage is important to avoid future legal complications.

  3. That no one has forced or influenced me to enter into this marriage.
  4. That I am fully aware of the consequences and legality of this marriage.
  5. That this affidavit is executed to place on record my free consent and willingness to this marriage.
