Khula (Divorce by Wife through Court)

Khula is a form of dissolution of marriage in Islamic law initiated by the wife and granted through a court. The term Khula literally means “to remove or untie the knot of marriage.” It is a legal right available to a wife when she is unable to continue the marital relationship within the limits prescribed by Islam.

If the right of divorce (Talaq-e-Tafweez) is not delegated to the wife in the Nikahnama, she may file a suit for Khula before the Family Court under the West Pakistan Family Courts Ordinance, 1964.

In such cases, a statement on oath by the wife that she can no longer live with her husband within the limits of Allah is generally sufficient for the grant of Khula.


Definition of Khula (Islamic Law)

In Islamic jurisprudence, Khula is defined as:

The dissolution of marriage at the instance of the wife in consideration of compensation paid or agreed to be paid by her to the husband.


Zar-e-Khula (Consideration in Khula)

Zar-e-Khula refers to the consideration (return or payment) given by the wife to the husband at the time of Khula, usually in exchange for the dissolution of marriage.

It may include:

  • Return of Haq Mehr (dower)
  • Cash payment
  • Property or jewelry
  • Any other agreed compensation

Grounds for Khula

A wife may seek Khula on the following grounds, among others:

  • Desertion by husband for a period of four years
  • Failure to provide maintenance
  • Contracting another marriage in violation of legal requirements
  • Husband’s imprisonment for seven years or more
  • Failure to perform marital obligations for three years
  • Continuous impotence from the time of marriage
  • Mental illness or serious disease of the husband
  • Cruelty, including physical or emotional abuse
  • Unequal treatment between co-wives
  • Any other valid ground recognized under Islamic law or family law

Procedure of Khula in Pakistan

  1. Filing of suit for Khula in Family Court
  2. Written statement and reconciliation proceedings
  3. Failure of reconciliation efforts
  4. Decree of Khula by the Court
  5. Issuance of Khula Decree and subsequent dissolution of marriage

This process is governed under the West Pakistan Family Courts Ordinance, 1964.
